TERMS & CONDITIONS OF SALE

These Terms & Conditions of Sale govern the relationship between Jenny Dee SARL, with registered office at Cours de Rive 10, 1204 Geneva, Switzerland (hereinafter “the Company” or “Jenny Dee”), and any person wishing to place an order (hereinafter “the Customer”).
These Terms & Conditions apply without restriction or reservation to all sales concluded by Jenny Dee in respect of products offered in the online catalogue of the website www.jennydeejewelry.com (the “Site”) as part of a distance-selling system.
Article 1 — Purpose
These Terms & Conditions set out the rights and obligations of the Customer in relation to the products sold in the catalogue of the website www.jennydeejewelry.com as part of a distance-selling system.
Placing an order implies irrevocable acceptance of these Terms & Conditions. The Customer declares that they have the legal capacity to enter into this contract, i.e. that they are of legal age and not under guardianship or curatorship.
Unreserved acceptance of these Terms & Conditions is expressed by the Customer ticking the box “I accept the Terms & Conditions of Sale”. Ticking this box shall be deemed to have the same value as the Customer’s handwritten signature.

Article 3 — Products
The products offered for sale are those shown on the Site on the day the Customer visits the Site. The Site does not sell second-hand, defective or sub-standard products.
The Customer’s attention is drawn to the fact that photographs illustrating the products may differ slightly from reality due to the settings of the Customer’s screen and the lighting conditions at the time of the photo shoot. Furthermore, as the products are artisanal creations, items may show slight irregularities of finish and differences in format and/or shade inherent to this type of craftsmanship, which cannot be considered major defects. The Company’s liability cannot be engaged on these grounds and the validity of the order cannot be affected by them.
The photographs, graphics and descriptions of the products offered for sale are indicative only and are not binding on the Company. Customers may obtain additional information by contacting the Company’s customer service by email or telephone.
Article 4 — Prices
Prices are displayed in CHF, EUR, GBP or USD depending on the delivery country selected by the Customer.
Prices are displayed exclusive of tax for all countries except Switzerland, and exclusive of shipping and customs costs.
Article 5 — Orders
Creating a personal account is not required to place an order on the Site. The Customer may also order by completing the express checkout offered by the Site and following the instructions.
After checking the contents of the order and its total cost (products ordered, shipping costs, optional extras), the Customer confirms the order definitively at the payment stage. This confirmation constitutes conclusion of the contract.
Once the contract is concluded, the Company will send the Customer, by email, an order confirmation containing a summary of the information entered on the order form. The invoice for the order will also be provided as an attachment to the email sent to the Customer.
The languages available for concluding the contract with the Site are English and French.
Article 6 — Payment Methods
For payment of the price of the products and shipping costs, the Customer shall follow the instructions shown at checkout.
The Customer may pay by credit or debit card (Visa, Mastercard, American Express, UnionPay), by express checkout (Apple Pay, Google Pay), by PayPal, by Klarna, or by local payment methods where offered (Bancontact, iDEAL).
In the case of payment by bank transfer, the Customer has five (5) working days from the order confirmation to transfer the agreed amount. A reminder will be sent to the Customer within 7 days if the amount has not been received in the Company’s bank account. The order may be cancelled if the Customer has not made the bank transfer within the time allowed. Items will be shipped once the full amount of the order has been received.
In the case of payment via PayPal, the Customer expressly acknowledges having read and accepted PayPal’s terms and conditions; PayPal is solely responsible for processing the personal data relating to the payment details entered by the Customer.
At the time of payment, the payment provider requests personal information from the Customer in order to verify the identity of the cardholder and validate the transaction. Financial information is transferred by means of an encrypted protocol to the relevant payment provider.
Upon conclusion of the transaction, the Customer is deemed to be acting lawfully.
Article 7 — Delivery
7.1 Shipping
All products sold on the Site are shipped by a freight-forwarding service and are subject to customs declaration for all international orders (outside Switzerland).
7.2 Availability and dispatch times
For in-stock products, orders placed on the Site will generally be processed and dispatched within 5 to 7 working days of receipt of payment (excluding weekends and public holidays), unless exceptionally indicated otherwise. An email will be sent to confirm processing and dispatch of the order.
For orders of products that are not in stock, please allow 3 to 6 weeks for production and shipping. You will be notified of this status before purchasing your product.
The Company delivers throughout the European Union and worldwide. The product ordered is delivered to the address shown on the Customer’s order form. The delivery address may differ from the billing address.
Delivery time depends on the delivery address. Any delay related to customs clearance of exported goods does not engage the Company’s liability. The stated delivery times run only from dispatch of the order.
It is the Customer’s responsibility to check the contents, conformity and condition of the product upon delivery. This check is deemed to have been carried out once the Customer, or a person duly authorised by the Customer, has signed the delivery note presented by the delivery service.
Despite the care taken in preparing orders, a product may be missing from an order, or an error may have occurred during preparation. If you notice such an error, please notify us by email at info@jennydeejewelry.com within a maximum of 48 hours of receiving the order.
7.3 Special orders
“Special” orders include personalisation of a jewel (in particular engraving) and made-to-measure creation of a jewel. Any buyer wishing to place a special order will be contacted by us to be informed of prices, creation times and shipping times.
Products corresponding to special orders may not be exchanged or refunded.
Article 8 — Right of Withdrawal and Returns
The Customer has fourteen (14) days to withdraw from their purchase. The fourteen (14) day period runs:
- from the day on which the Customer, or a third party designated by the Customer other than the carrier, received the item ordered; or
- in the case of an order for several items delivered separately, from the day of each delivery on which the Customer, or a third party designated by the Customer other than the carrier, received the item(s).
The Customer must notify the Company by sending an email stating: the order number, the reasons for the withdrawal, the Customer’s personal details, and the date.
The Customer must return the product within fourteen (14) days of notifying their withdrawal, to the address indicated to them by email, using a carrier approved by the Company. Return shipping costs are borne by the Customer.
After receipt and inspection of the returned products, the Company will, within fifteen (15) working days, refund the payments received, excluding shipping costs, in the form of a credit valid on the Site or an exchange of the product.
Exchanges and refunds in the form of Site credit will only be accepted if all of the following conditions are met:
- The product has not been worn, used, altered, washed or damaged;
- The product was not made to measure (see Special Orders, Article 7.3);
- The product is returned in its original packaging together with the purchase invoice.
Where the return of the product by the Customer is due to an error by the Company — such as a product missing from the order, a non-conforming product (subject to Article 3 above) or a manufacturing defect — the Company undertakes to refund, in the form of credit on the Site, the purchase price of the product as well as the shipping costs incurred by the Customer for delivery. The Customer must report the error by email to info@jennydeejewelry.com within a maximum of 48 hours of receiving the order.
No refund in the form of credit or exchange will be granted to a Customer who has not exercised their right of withdrawal in accordance with this Article.
Article 9 — Warranty
In the event of a manufacturing defect, the Company offers a warranty covering such defects for a period of one year from the date of purchase (two years for orders placed within the European Union).
Items under warranty that prove defective will be repaired where possible, or exchanged. In the event of an exchange, an identical model cannot be guaranteed; the consumer is entitled only to an item of equivalent value.
The Company’s warranty applies to normal use. The following are excluded from the warranty: ageing; wear of rhodium plating; wear and alteration caused by the use of perfume; and deterioration, breakage or loss resulting from an accident, the intervention of a third party, improper use or lack of care.
The warranty is exercised upon presentation of the certificate duly dated and stamped by the Company.

Article 11 — Intellectual Property
The Site is the property of the Company. It is protected by international copyright laws and treaties.
All rights relating to the Site and its concept belong to the Company. The texts, literary, artistic, graphic (including photographs) and audiovisual creations, software developments, HTML developments and other works of the mind and, more generally, all creations capable of protection under intellectual property law — such as images, logos, layout, graphic charter, structure, ergonomics, colour codes, typography, basic graphic elements, screen layout, page backgrounds and the visual identity of the Site — belong to Jenny Dee and are lawfully used by the Company without limitation.
The Customer undertakes not to infringe, directly or indirectly, the rights of the Company or the Site.
Article 12 — Personal Data
The collection and processing of the Customer’s personal data in connection with orders and use of the Site are described in the Company’s Privacy Policy, available at jennydeejewelry.com/policies/privacy-policy. Providing certain personal information (in particular name, postal address, telephone number and email address) is necessary for the validation and delivery of orders; a Customer who does not wish to provide this information will not be able to order on the Site.
Article 13 — Amendments and Updates
These Terms & Conditions may be amended from time to time, in particular to reflect regulatory changes. The new Terms & Conditions will apply from the date of their publication on the Site.
Article 14 — Miscellaneous
Should any clause of these Terms & Conditions be found null or unenforceable under any law or regulation, or following an enforceable decision of a competent court, the Customer and the Company expressly agree that this contract shall not be affected by the nullity of the clause in question.
The failure of either party at any time to require strict performance by the other party of any provision or condition of these Terms & Conditions shall not be deemed a definitive waiver of that provision or condition.
